Overview
162-0 (“we,” “our,” or the “Service”) is a baseball fantasy draft game operated by VG Northern Technologies, LLC. This Privacy Policy applies to the 162baseball.com website and the 162-0 mobile application and explains what information we collect, how we use it, when it may be shared, how long it is retained, and the choices available to users.
The Service is intended only for individuals 18 years of age or older.
1. Information We Collect
Account Data
When you sign in through Clerk, our authentication provider, we receive your unique user ID and email address. We use your email address to associate and operate your account. Your email address is not displayed publicly. Authentication credentials and passwords are handled by Clerk; VG Northern Technologies does not directly store your password.
Profile and Preference Data
Depending on the features you use, we may store your public username and optional profile or preference information such as your franchise name, favorite MLB team, profile colors, profile visibility setting, game-email preference, theme, and theme mode.
Game and Activity Data
We store information related to your use of 162-0, which may include simulated season records, scores, wins and losses, drafted rosters, game timestamps, career statistics, daily challenge participation, streaks, achievements, boss attempts or progress, gauntlets and gauntlet match history, and head-to-head challenge history. This information is used to operate game modes, leaderboards, career statistics, achievements, and related features.
Social Data
If you use social features, we may store friend relationships, friend requests, head-to-head challenges, and related interactions with other users.
Notification and Reminder Data
If you enable optional Daily Challenge or Daily Diamond push reminders, we may store an app-generated installation identifier, device platform, your selected reminder time and time zone, and information necessary to deliver the reminder. On the native mobile application, this includes an Expo push token. On the website, this includes a browser push-service endpoint and associated encryption and authentication keys (including the p256dh public key and auth secret). We may also store limited notification-delivery records, such as delivery status, attempt and retry timestamps, provider message identifiers, and sanitized error codes.
2. Information We Do Not Directly Collect
We do not directly collect or store your password. Authentication credentials are handled by Clerk.
We do not currently collect payment information or precise location information as part of the Service.
Third-party providers used to operate, host, authenticate, secure, analyze, or deliver the Service may process limited technical information necessary to provide their services, which may include ordinary network or request information such as IP address, browser or device information, timestamps, security logs, or similar technical data. Their processing is also governed by their respective privacy practices.
We do not sell personal information, use personal information for targeted advertising, or use personal information for profiling in furtherance of solely automated decisions that produce legal or similarly significant effects concerning a user.
3. How We Use Your Information
- operate and maintain your account;
- display scores and usernames on leaderboards and other game features;
- track career statistics, achievements, streaks, and game history;
- enforce daily challenge and game-mode limits;
- operate head-to-head challenges, gauntlets, boss modes, and other gameplay features;
- operate friend and social features;
- deliver and manage optional Daily Challenge and Daily Diamond push reminders that you enable;
- associate game history with your account across sessions and devices;
- prevent fraud, cheating, abuse, security violations, manipulation, and other misuse of the Service;
- communicate with you about your account or gameplay; and
- operate, maintain, secure, and improve the Service.
4. Public Information
Your public username and certain game information may be displayed through the Service. If your profile is set to public, information visible to other users or public visitors may include your username, franchise or profile customization, favorite team, profile colors, career or gameplay statistics, achievements, best-team information, gauntlet information, and other information intentionally presented on your public profile.
New profiles are public by default. You may switch to a private profile at any time through the profile-visibility setting, which removes your profile from public profile and search functionality going forward.
Your email address is not displayed as part of your public profile.
Do not include your real name, contact information, or other identifying information in your username unless you want that information to be publicly visible.
5. Local Storage, Cookies, and Similar Technologies
Website
The website uses browser local storage, cookies, or similar technologies to support features and preferences. Locally stored information may include theme preferences, in-progress draft or game state, daily challenge state, whether instructional content has been shown, and your analytics-consent choice.
Mobile Application
The mobile application may use on-device or secure storage necessary to operate the application and maintain authentication sessions. Clerk authentication tokens are stored using secure device storage where supported. Authentication tokens are not intended to be exposed in public application interfaces or logs.
If you decline analytics on the website, PostHog analytics are not activated for your use of the website. If you accept analytics, PostHog may use cookies or similar technologies to maintain consistent analytics sessions. You may change your analytics preference through Settings.
6. Analytics
We currently use PostHog analytics on the 162baseball.com website to understand how the website is used. Analytics are enabled only after you consent.
When website analytics are enabled, PostHog may receive:
- pageviews or screen views;
- game-related events, such as beginning a draft or completing a game;
- your account ID; and
- your public username when you are signed in.
Analytics Details
Your email address is not intentionally sent to PostHog as part of our analytics identify events.
If you decline analytics, analytics tracking remains disabled and the Service will attempt to clear or opt out applicable PostHog analytics state where technically supported.
The current native mobile application does not use PostHog analytics. If mobile analytics practices materially change, this Policy will be updated as appropriate.
PostHog processes information in accordance with its own privacy policy.
7. Push Notifications and Game Emails
Push Notifications
Push notifications are optional and are currently used only for Daily Challenge and Daily Diamond reminders. Push registration occurs only after you grant notification permission and enable a reminder. Current push-notification payloads are generic and contain the reminder type, challenge date, and a destination within 162-0. They are not intended to contain your name, email address, roster, score, opponent information, private profile information, or other private account or gameplay details.
Mobile push notifications are sent by the 162-0 backend through Expo Push Service, which may route notifications through Apple Push Notification Service (APNs) or Firebase Cloud Messaging (FCM), as applicable. Website notifications use the standards-based Web Push protocol and are delivered through the browser or platform push-notification service associated with your browser or device.
You may disable reminders at any time through the Service or applicable device or browser settings. When notification permission is withdrawn or no enabled reminder requires a registration, the active push registration is removed. If one reminder remains enabled, a shared device or browser registration may remain active for that reminder.
Game Emails
We may send game-related emails, such as notifications that an opponent has completed a head-to-head challenge. To deliver these messages, we may provide your email address to Resend, our email-delivery provider, when an email is sent.
You may turn optional game emails off through Settings. Authentication, security, and account-related emails handled by Clerk may operate separately from this setting.
8. Third-Party Services
Clerk: Clerk handles authentication and processes authentication information according to its privacy practices. We receive your user ID and email address as described above. Privacy information
Replit: The Service uses Replit infrastructure for application hosting and related server functionality. Replit may process ordinary technical information necessary to provide and secure its infrastructure. Privacy information
PostHog: PostHog provides consent-gated website analytics as described in Section 6. Privacy information
Resend: Resend provides email-delivery services as described in Section 7. Privacy information
Expo and Push Delivery Services: For optional mobile push reminders, 162-0 uses Expo Push Service, which may use Apple Push Notification Service (APNs) or Firebase Cloud Messaging (FCM) to complete delivery. Website reminders are delivered through applicable browser and platform push-notification services using the Web Push protocol. These services may process push tokens, browser push endpoints, notification payload information, and related delivery information as necessary to deliver the reminders you request. We may replace or add service providers as the Service evolves. We will update this Policy when a material change affects how personal information is processed.
9. When We May Share Information
We do not sell your personal information.
Service Providers
We may share information with service providers that help us operate, secure, authenticate, analyze, or deliver the Service, as described in this Policy.
Legal Requirements
We may disclose information when reasonably necessary to comply with applicable law, regulation, court order, subpoena, governmental request, or other legal process, or to protect the rights, property, security, or safety of the Service, VG Northern Technologies, our users, or others.
Aggregated or Anonymized Information
We may use or share statistical information that does not reasonably identify an individual, such as aggregate information about game usage or player selections.
Business Transfers
If VG Northern Technologies, LLC or the 162-0 Service is involved in a merger, acquisition, reorganization, financing, transfer, or sale of some or all of its assets, information may be transferred as part of that transaction, subject to applicable law.
10. Data Retention and Account Deletion
We generally retain account information and identifiable game history while your account remains active.
Voluntary Account Deletion
You may permanently delete your account through Settings. When you voluntarily delete your account, we remove your active profile and account-associated application records, including identifiable account information, subject to the limited exceptions described below.
Completed head-to-head, gauntlet, or other shared game records may be retained in anonymized or de-identified form when necessary to preserve another user’s game history. For example, another user may continue to see that a game occurred against a deleted account without retaining information that identifies the deleted user.
Aggregated or anonymized information that no longer reasonably identifies you may also be retained.
Push-Notification Records
Active push registrations are retained while needed for an enabled reminder. Invalid or retired push-device registrations are deleted within 30 days. Notification-delivery history, including delivery status, attempt and retry information, provider message identifiers, and sanitized error codes, is deleted within 90 days. Reminder time and time-zone preferences may be retained while your account exists or until you remove the applicable reminder preference. Account deletion removes push registrations, reminder preferences, and associated notification-delivery records, subject to the limited provider-record and backup exceptions described below.
Provider Records and Backups
Limited information may remain temporarily in backups, security logs, email-delivery records, analytics records created with consent, or other service-provider systems according to applicable provider retention practices, technical limitations, legal requirements, or legitimate security and operational needs. We do not represent that deletion from every third-party backup or operational log occurs instantaneously.
Accounts Terminated for Violations
If VG Northern Technologies terminates or restricts an account because of suspected fraud, cheating, harassment, manipulation, security violations, abuse, or another violation of the Terms, we may retain limited information reasonably necessary to investigate or document the violation, prevent repeated fraud or abuse, protect the Service or other users, resolve disputes, establish or defend legal claims, or comply with applicable law. Public-facing account information may still be removed even when limited internal records are retained.
11. Age Requirements
162-0 is intended only for individuals who are 18 years of age or older. Users must confirm that they are at least 18 years old when accepting the Terms or creating an account as required by the Service.
We do not knowingly permit individuals under 18 to maintain an account. If we learn that an account belongs to an individual under 18, we may terminate the account and take reasonable steps to delete associated personal information, subject to applicable legal requirements.
12. Your Rights and Choices
Depending on where you live and subject to applicable law, you may have rights concerning your personal information. We will honor legally valid privacy requests as required by applicable law and may honor reasonable requests even when a particular privacy statute does not apply to us.
Your Privacy Rights
- Access and confirmation — You may request confirmation of whether we process personal information about you and request access to that information.
- Correction — You may request correction of inaccurate personal information, taking into account the nature of the information and the purposes for which it is processed.
- Deletion — You may request deletion of personal information provided by or obtained about you, subject to legal and operational exceptions. You may also use the account-deletion feature in Settings where available.
- Data portability — You may request a copy of personal information that we process about you in a portable and, where technically feasible, readily usable format.
- Opt-out rights — Where applicable, you may opt out of the sale of personal information, targeted advertising, or profiling in furtherance of solely automated decisions that produce legal or similarly significant effects.
- Withdraw consent — Where processing is based on your consent, you may withdraw that consent through the applicable in-product control or by contacting us. For example, website analytics consent may be changed in Settings.
How to Exercise Your Rights
You may exercise available privacy rights through account controls in the Service where a relevant control is provided, or by emailing admin@162baseball.com with the subject line “Privacy Request.” Please describe the right you wish to exercise and provide enough information for us to understand and, where required, verify the request. We will not require you to create a new account solely to submit a privacy request, although we may require you to use an existing account or verify control of the email address associated with the account.
Where permitted by applicable law, an authorized agent may submit certain requests on your behalf. We may take commercially reasonable steps to verify your identity, the agent’s identity, and the agent’s authority to act for you.
Response Timing and Fees
Where required by applicable law, we will respond to a verified privacy request without undue delay and generally within 45 days after receipt. If reasonably necessary because of the complexity or number of requests, we may extend the response period by an additional 45 days and will notify you of the extension and the reason for it within the initial response period.
Where required by law, responses will be provided free of charge at least once during any 12-month period. If a request is manifestly unfounded, excessive, or repetitive, applicable law may permit us to charge a reasonable fee or decline to act on the request.
Appeals
If we decline to take action on a privacy request, we will provide the reason for the decision and, where required by applicable law, instructions for appealing it. You may submit an appeal by emailing admin@162baseball.com with the subject line “Privacy Appeal” and identifying the request or decision you are appealing.
Where New Hampshire RSA 507-H or another applicable law provides an appeal right, we will respond to the appeal within the time required by law, including within 60 days where RSA 507-H applies. If an appeal is denied and applicable law requires it, we will provide information about how to contact the appropriate state attorney general or other regulatory authority to submit a complaint.
Current Opt-Out Practices
162-0 currently does not sell personal information, use personal information for targeted advertising, or conduct profiling in furtherance of solely automated decisions that produce legal or similarly significant effects. Website analytics are consent-based and may be disabled through Settings. If our practices change in a way that creates additional opt-out rights, we will provide the controls and notices required by applicable law, including recognition of legally required opt-out preference signals where applicable.
13. Changes to This Policy
We may update this Privacy Policy as the Service evolves. When we make material changes, we will update the effective date and provide reasonable notice through the Service, by email, or through another appropriate method. Where applicable law requires affirmative consent to a change in our data practices, we will obtain that consent before the change applies.
